Object
1.1 These General Conditions, updated in January 2022, are intended, together with the order form, and the other elements referred to therein, to regulate the terms and conditions governing the provision of the Port & Friends Wine Store Online Shop Service (www.portandfriends.com), with offices at Rua da Misericórdia 25, 3460-557 Tondela under the single registration and individual entrepreneur identification number (ENI) no. 239379764, whose owner is André Lindo.

1.2 The purchase of any product in the Port & Friends Wine Store Online Shop implies acceptance of these General Conditions of Online Sale.
1.3 Any and all alcoholic beverages available for sale in the Port & Friends Wine Store Online Shop may only be purchased by persons of legal age in their country of residence. By making a purchase on the site, the customer declares that they are over 18 years of age and do not have any legal impediment or restriction that makes it impossible for them to purchase alcoholic beverages.
Product, Price and Content Information
2.1 Port & Friends Wine Store reserves the right to modify, without prior notice and at any time, the information and commercial offer presented regarding: products, prices, promotions, commercial conditions and services.
2.2 The images illustrating each product in the Port & Friends Wine Store may differ from the product subsequently delivered, and these products are also subject to stock-outs.
2.3 Despite Port & Friends Wine Store’s best efforts, some products may be inaccurately priced, which is why the company checks prices every time it processes orders. Consequently, the prices shown on Port & Friends Wine Store are merely indicative and do not constitute a contractual offer. If the actual price of the product is lower than the advertised price, Port & Friends Wine Store will refund the difference. If the price is higher, Port & Friends Wine Store will inform the customer of this situation by e-mail and await their decision to accept the new price or cancel the order within 15 days of the date on which the e-mail was sent.
2.4 In accordance with Portuguese law, all prices shown at Port & Friends Wine Store include the respective VAT rates in force, unless otherwise stated.
Ordering and payment
3.1 Once the order has been confirmed at Port & Friends Wine Store, an e-mail will be sent to the contact address registered by the customer with all the details about delivery, invoicing, payment information, products and values. Port & Friends Wine Store suggests that all customers confirm their order details. If the customer does not receive the order confirmation e-mail, they are asked to contact Port & Friends Wine Store so that this notification can be sent again to the customer’s e-mail address.
3.2 If any of the details placed by the customer in the order are incorrect and/or the customer wishes to change any information, provided that the order has not yet been dispatched, the customer is asked to contact us as soon as possible so that the requested change can be made internally. Changes to details of orders that have already been dispatched will have to be analyzed by the Port & Friends Wine Store team so that, together with the customer, the most appropriate solution can be found.
3.3 All orders at Port & Friends Wine Store will only be processed once payment has been received. The formalization of the order does not in itself constitute a reservation of the products.
3.4 If an order cannot be fulfilled in part or in full, the customer will be contacted immediately by Port & Friends Wine Store in order to find the most appropriate solution.
3.5 All orders placed with Port & Friends Wine Store have a maximum payment period of 5 days. After this period, the order will be automatically canceled.
3.6 Orders may be canceled when expressly requested by the customer prior to shipment. Once the order has been confirmed for shipment, the customer is asked to contact Port & Friends Wine Store so that the most appropriate solution can be found together.
3.7 Payment methods: Payments by ATM reference and credit card are accepted through the Port & Friends Wine Store Online Shop. Payment by bank transfer is also possible, upon request by the customer.
3.8 The status of orders at the Port & Friends Wine Store is divided into 3 phases: Pending, In Process and Finalized:
a) Pending: Awaiting receipt of payment in the Port & Friends Wine Store system;
b) In Process: Phase in which payment has already been received and the order is being processed and packaged / prepared;
c) Finished: The order has already been shipped.
Shipping
4.1 In addition to the prices shown on the products, the respective shipping costs are added to each order, which are calculated based on the following factors: the weight and value of the goods, and the country of destination of delivery. This shipping cost can be simulated in the shopping cart with the desired products added and by filling in all the required fields in the simulator. The total shipping costs will also be calculated automatically when you place your order in the Online Shop. Please note that the factors in this calculation may vary and change without prior notice.
Shipping will be free in the following cases:
- Free shipping for purchases over €50 to mainland Portugal and mainland Spain.
- Free shipping for purchases over €100 to Madeira and the Azores.
- Free shipping for purchases over €450 to Europe.
4.2 In general, it takes time for an order to be delivered to Port & Friends Wine Store after it has been dispatched:
- Between 24 and 48 hours in mainland Portugal;
- Between 5 and 7 working days in Madeira and the Azores;
- Up to 4 working days in Peninsular Spain;
- Up to 5 working days in the European Union;
- Outside the European Union, delivery time will depend on customs clearance.
4.3 Port & Friends Wine Store is not responsible for shipments made to countries where the law does not allow alcoholic beverages to enter. Customers are responsible for the possible seizure of their orders, as well as the payment of customs fees, if any. If the products are returned, Port & Friends Wine Store will only refund the amount of the products. If in doubt, the customer should contact Port & Friends Wine Store before ordering.
4.4 Port & Friends Wine Store has a contract with specialized carriers for deliveries to Portugal, Europe and most countries in the world. Every effort is made to meet shipping and delivery deadlines, however it should be noted that possible delays in deliveries may be due to something other than Port & Friends Wine Store, and in such cases it is not possible to guarantee exact delivery times.
4.5 Most deliveries are made during business hours on working days to the shipping address indicated by the customer when submitting the order.
4.6 In the event of an unsuccessful delivery attempt by the transport company due to absence, a waybill is always left in the customer’s mailbox with the carrier’s instructions. Depending on the service and the carrier, parcels must be collected at the place indicated by the carrier on the transit note, or the instructions requested on the same note must be followed.
4.7 If for any reason the customer is unable to receive the order or pick it up at the location indicated by the carrier, the customer is requested to contact Port & Friends Wine Store so that together the most appropriate solution can be found.
4.8 All products sent by Port & Friends Wine Store must be checked upon delivery. If the customer finds that the order is damaged, they must immediately return it to the transport company, duly justify the reason for the return on the carrier’s delivery note and immediately notify Port & Friends Wine Store.
4.9 If, after delivery, the customer finds that any of the items are not in conformity, they are asked to contact Port & Friends Wine Store immediately by e-mail quoting the order number or the number of the document that accompanied the order, attaching images of the packaging as received and of all the items, so that a process can be opened internally to investigate the occurrence and so that the situation can be resolved as soon as possible.

Applicable Law
